Can I File a Hernia Mesh Lawsuit for Complications After Surgery?

New Jersey Attorneys Explain Product Defects and Dangers of Surgical Mesh

Manufacturers of consumer products, including medical devices, are responsible for putting safe and dependable devices on the market. Unfortunately, these large companies sometimes rush products to the market without proper testing and fail to warn consumers of the risks associated with their products. Hernia mesh manufacturers are no exception. The negligence of these companies has caused many patients to experience severe complications from their surgical mesh. In many cases, the defective mesh erodes or migrates, causing internal injury and severe pain. Often, victims must undergo additional surgeries to correct the problem. As a result, hundreds of hernia mesh lawsuits have been filed against the manufacturers that produced the defective mesh.

The New Jersey product liability attorneys at Keefe Law Firm have experience fighting for the rights of consumers and victims of product defects. If you are considering a hernia mesh lawsuit, then contact our law firm today. We can answer your questions and explain your right to compensation.

What is Hernia Mesh?

A hernia is an opening or weakness in the muscle or tissue wall that allows surrounding organs to poke through. Hernias typically occur in the lower abdomen, although other locations are possible. The causes of a hernia can range from obesity and smoking to persistent coughing and poor nutrition. Left untreated, hernias could expand and additional organs could protrude through the opening. This often causes a visible bulge in the skin. If an organ becomes trapped in the opening, then the organ may become strangulated and lose blood flow. This may cause the tissue of the organ to die, creating a serious, life-threatening medical condition. Additionally, if a hernia gets to be too large, then it becomes almost impossible to fix. Untreated hernias can also cause swelling, discomfort, tenderness and pain in the body.

To avoid these symptoms, many people undergo an operation to repair their hernia using surgical mesh. The mesh is implanted over or inside the hernia to provide additional support to the weakened tissue or muscle. Eventually, new tissue should grow over the mesh, eliminating the hernia. However, product defects in many brands and types of implants may cause serious hernia mesh complications.

What Are Common Hernia Mesh Problems?

Since hernia mesh implants have been on the market, many consumers have suffered severe complications after undergoing hernia repair using surgical mesh. Some of these complications include infection, adhesion, and nerve damage. In some cases, hernia mesh erosion may also cause the hernia to reoccur.

The public’s response to these complications resulted in several hernia mesh recalls. In May of 2016, Johnson & Johnson’s Ethicon division issued a voluntary recall of its Physiomesh Flexible Composite Mesh. The company initiated the recall after discovering increased rates of hernias reoccurring and high instances of revision surgeries.

Similarly, Novus Scientific issued a Class II recall of its TIGR mesh. In addition to these two major companies, various other hernia mesh manufacturers have also recalled their surgical mesh products for various reasons. These include mislabeling or misleading packaging, meshes made of counterfeit materials, and design and manufacturing defects.
