A person has a right to challenge their yearly tax assessment. Right when you get your assessment is when you should seek counsel. That way you can determine if the property has been assessed for the value that it is. Municipal assessments come out every year, and very often you know the client has a right to challenge the assessment that the municipal tax assessor imposes on the property. It’s at that point when you get your assessment from the town that you should seek counsel to be able to determine if the property has been assessed for the value that it is. And if the property’s not assessed, at what’s considered fair market value, then the client has the right to file a tax appeal with the County Tax Board, to be able to challenge the assessment. I’ve represented clients in those matters and very often it starts with a hearing at the county level, but at some point if the client’s not satisfied, you have a right to appeal to the state tax court as well. And I’ve represented clients in tax appeal matters for a number of years and very often you know the assessments are right, but sometimes they’re not and in those cases that the client does have the rights to challenge them.
